Judge: This is a heartbreaking situation

Background Info

Michelle Wheeler, initially charged with 2nd Degree Murder in the January 2009 death of her boyfriend of approximately 5 years Jerry Cisco, pled to Manslaughter in March. Her sentencing hearing was yesterday, and I left the courtroom with a renewed appreciation for how tough a judge's job can be. See also my earlier blogs about this case.

Cisco and Wheeler had a tumultous relationship that involved alcohol abuse and violence by both parties. Cisco had been arrested on at least 5 occasions for domestic battery against Wheeler. The Court heard testimony about the injuries she had sustained over the course of their relationship: cuts with a knife, numerous bruises, broken bones, and a busted eardrum. A search of the Orange County Clerk's records show 11 cases against Cisco going back to 2004 for the following charges:
  • 3/22/04: Resisting Officer w/o Violence
    Case nolle prossed (dropped).
  • 3/25/04: Driving Under the Influence
    Adjudicated guilty - 1 year probation.
  • 4/28/05: Assault (2 counts)
    Pled no contest - adjudicated guilty 8 days jail w/credit 8 days time served; 160 days probation; no contact with victims (two of Wheeler's family members) - Cisco subsequently violated this probation in December 2005 and served 37 days jail.
  • 5/14/05: Battery DV
    No Information (the formal charging document) was filed by State. Cisco violated terms of Home Confinement in this case, but since no Information was filed, there were no sanctions imposed.
  • 6/24/05: Battery on Law Enforcement Officer; Threats Against Public Servant
    Pled no contest and was adjudicated guilty both counts - sentenced to 27 days in jail w/credit 27 days time served; 48 months probation (concurrent with other case); 100 hours community service; anger management seminar; substance abuse evaluation; apology letter. Cisco was subsequently found in violation of probation June 2007 and served 171 days in jail in spite of Wheeler's declination of prosecution.
  • 6/28/05: False 911 Calls; False Reports of Commmission of Crimes
    Pled no contest and adjudicated guilty of both counts. Sentenced to 160 days w/credit 160 days time served.
  • 7/11/05: Burglary of Dwelling w/Assault or Battery; Aggravated Stalking w/Credible Threat; Battery; Criminal Mischief
    Burglary charge was dropped, pled to all other charges and sentenced to 1 year jail w/credit 101 days time served; 42 months probation; anger management seminar; and 75 hours community service. Cisco was subsequently found in violation of probation June 2007 and served 210 days in jail in spite of Wheeler's declination of prosecution.
  • 11/17/05: Aggravated Battery w/Deadly Weapon; Aggravated Assault w/Deadly Weapon; Aggravated Battery on Pregnant Person
    No Information was filed by the State.
  • 6/20/06: Felony Battery
    Pled no contest & adjudicated guilty. Sentenced to 64 days jail w/credit 64 days time served, ordered to have no hostile contact with Wheeler (who had filed a declination of prosecution).
  • 7/4/07: Battery
    No Information was filed by the State.
  • 12/28/07: Battery DV
    No Information was filed by the State.
Wheeler's criminal record for the same timeframe:
  • 12/14/04: Battery
    Case nolle prossed.
  • 10/21/06: Disorderly Intoxication
    No Information was filed by the State.
  • 9/28/08: Battery (4 counts); Disorderly Intoxication
    Pled no contest to one count and sentenced to 60 days jail with credit 42 days time served; substance abuse treatment while in jail. Other counts were nolle prossed.
  • 1/16/09: 2nd Degree Murder (victim: Jerry Cisco)
    Pled to Manslaughter w/Deadly Weapon.
In addition to the above, Wheeler was sentenced in 2004 to 18 months prison for violating probation in a 2000 case where she pled to Burglary of a Conveyance. She was released from custody in August, 2004. This case occurred before her relationship with Cisco began.

Testimony Provided

Both sides of the courtroom had half a dozen or so family members present. The victim's family made the trip from Kentucky.

Media representatives were not in attendance.

Ms. Wheeler's mother, father and sister, who have been caring for the couple's children (ages 3 & 4), spoke on her behalf. They expressed their apologies to Cisco's family for the loss of their loved one. In addition to testimony about the victim's alcoholism and injuries inflicted upon Wheeler, they told the judge about the defendant's own alcohol abuse and did not sugarcoat her criminal history. Wheeler's sister testified that she and her husband had been very close friends with Cisco, but that after Cisco and Wheeler's relationship began, he became violent and threatened to kill Wheeler on several occasions. She told the judge that she and her mother had taken Wheeler to the hospital on several occasions after altercations with Cisco. She also stated that she always thought that the situation would be reversed, expecting that her sister would end up dead.

Dr. Allen Burns, court-ordered psychiatrist (one of three who had evaluated the defendant), testified that she was not insane at the time of the offense. He stated that she suffers/suffered from schizoaffective disorder, bipolar disorder, post-traumatic stress disorder, panic attacks, and had intermittent auditory hallucinations.  In addition to a history of being a victim of domestic violence, she was a victim of sexual abuse in the past. He found that she did not meet the criteria for involuntary hospitalization and that she was no imminent risk to herself or to others. He recommended that she continue on the medications that have stabilized her since her incarceration, that she undergo treatment for her alcohol dependency, and have therapy for the symptoms of PTSD.

Defense Counsel Chung-Wook Kim then called Michelle Wheeler to testify. She told the judge about the afternoon that led up to the fatal event, but never once spoke about the actual incident (in the bond hearing last year, there was testimony that Cisco had threatened to kill her several times throughout the day and once he grabbed a knife, she begged for her life, convinced him to drop it, and then picked it up and stabbed him). She told the judge that she had personally contacted law enforcement 5 times for help during their relationship, and her neighbors and sister had also called on several occasions.

When asked why she didn't leave the relationship, her reply was something every domestic violence advocate hears from victims - he promised to stop hitting her, she feared for her life if she did leave (there were threats to kill her and burn down the house), and she wanted to keep her home intact for their children.

As she read a prepared statement to Cisco's family, Judge Adams suddenly seemed to lose interest in what the defendant had to say. He began to look away as he searched for something in file drawers and on top of the bench. It struck both of the courtwatchers as disrespectful. It was the only time he did not appear to give the person testifying his full attention.  Wheeler apologized to Cisco's family, said she never meant to hurt him and that she still loved him. She told of the pain and grief she is experiencing in losing both Jerry and not seeing her children.

She told the judge that she has completed all the programs offered to her at the jail and that she is pursuing her GED. She indicated that she is willing and able to comply with any conditions of release that might be imposed upon her. She admitted that she had injured Cisco in the past, but that any violence she perpetrated upon him was a result of him being the aggressor.

Assistant State's Attorney Les Hess elicited testimony about the defendant's previous record (above) as well as some older incidents from the 1990s. He focused on the fact that their relationship often involved "mutual combat." Wheeler also told the Court that every time she had had a brush with law enforcement, alcohol had been a factor.

The most compelling witness was the victim's older sister, Trina Penny, who read a victim impact statement that was well written and delivered with passion. As one who has lost a child to murder, I saw myself in the family's shoes, particularly those of the victim's mother, as they described the shock and grief they experienced when learning of Cisco's death, as well as the struggle they face to accept the reality of the situation in those first few days and weeks.

Her anger at the defendant was evident, yet I was surprised that neither she nor her mother (who called in from North Carolina), were willing to admit that Cisco had played any part in the violence in the relationship. She idealized her little brother, never once conceding that he had a problem with alcohol. She talked about Wheeler's "questionable children" as if to imply that Cisco was not their father. She blamed Wheeler for causing her brother to lose hope, his health, integrity and enthusiasm for life. She accused Wheeler for being responsible for isolating him from his family, ruining him financially, and claimed that he was unable to move back to Kentucky because he feared for the safety of their children. She asserted that her brother was a victim of domestic violence, but because he is a man, there are no domestic violence groups supporting his side of the story (I'll write more about that tomorrow). She told the judge that Wheeler deserves to die for what she did.

Attorney Arguments

The Defense requested a Downward Departure from the sentencing scoresheet of 10.5 years because of several mitigating factors per Florida Statute 921.0026(2):
(c) The capacity of the defendant to appreciate the criminal nature of the conduct or to conform that conduct to the requirements of law was substantially impaired.

(d) The defendant requires specialized treatment for a mental disorder that is unrelated to substance abuse or addiction or for a physical disability, and the defendant is amenable to treatment.

(f) The victim was an initiator, willing participant, aggressor, or provoker of the incident.

(g) The defendant acted under extreme duress or under the domination of another person.
The judge needed only to find that one of the above applies.
From where we sat (in the cheap seats), I would have to say that both (f) and (g) above would apply, perhaps even (c), but there was no testimony about whether she was impaired, even though she did indicate they had both been drinking that night.

The State requested no Downward Departure, claiming that this is not the first time that Wheeler had faced prison time and lied (she initially claimed Cisco had committed suicide when law enforcement was called to the scene).

The Sentence

Judge Adam's first comment was that "This is a heartbreaking situation." He recognized that everyone in the courtroom was suffering as a result of what transpired on January 16, 2009. He commented that both parties contributed to the environment and that alcoholism takes a terrible toll on everyone involved. He did not find it surprising that the defendant initially lied about what happened because addicts often lie to themselves and others about their addiction as well as the situations in which they find themselves.

The judge did not find grounds to downward depart, stating that Wheeler was a willing participant. The notion that Wheeler willingly participated in the violence indicates a terrible misunderstanding of the dynamics of domestic violence. I'll explain why tomorrow.

The sentencing guidelines called for a minimum 10.5 year sentence. She could have received a maximum of 30 years.

Judge Adams ordered that Wheeler serve 20 years in DOC plus an additional 10 years of probation upon release. She was ordered to consume no alcohol and participate in substance abuse treatment with random urinalysis. She was given credit for the 1 year 150 days time served.

As he announced his sentence, Wheeler turned around with a panic-stricken look on her face and asked her sister to take care of her children. Whether or not Cisco's family has any interest in them is unclear.

It was indeed a heartbreaking (nearly 2-hour) hearing for everyone concerned.

  2. As a I read the following information, I became severely sick to my stomach!That anyone could get away with so much violence upon another person, and the courts and the police be involved! Is proof or Justice system is failing! As you read the following charges above, clearly you can see that Cisco was a repeated offender of physical and mental abuse!!! How many times does a man have to go to jail for domestic abuse, before something is done? I'm not saying that the women was with out fault,but its as clear as a bell that this man knew how to play the system to his advantage.Of all the charges that was against him for the same thing, surely any Judge could see it was self defense! I could and I'm not even a lawyer! And as for his Family were where they when all this was going on? I'm sure they had to be aware of the the abuse this man was capable of!!!! From what I read all they wanted was revenge!!!And that's just as bad as the abusive Cisco! I feel sorry for Wheller, and her children that will have to grow up with out there mother.And as for the question above about DNA Proof that the children are his , I'm sure if you ask the family they will provide you proof, Its very clear you must be a family member of Cisco!!

  3. First of all this man was a loving and caring husband and father. The picture that was painted in this trial was full of half truths. Wheller has had a history of violence all of her life. Wheller has been in and out of trouble with the law just as Cisco had. This woman has always been a walking time bomb ready to go off at any time any place. To say that Wheller was defenseless is just crazy. She was jealous of the love Cisco still carried for his first wife. Cisco tried to end their relationship so many times but Wheller just kept comming back. Wheller has never been one to take NO well. I am not a family member, I'm just someone who knew both familys. I so feel sorry for the kids involved. As adults we are held accountable for our actions. It is time that Wheller pays for her actions!

  4. yes as adults we are accountable for our actions, so when would have cisco ever been held accountable for his.. as a mutual friend as well, you cannot pick a side and look from the outside and look in, they were both in the wrong and we all know this, but to put all the blame on one party is wrong and disrespectful, cisco's family is in pain we know they have lost a member to their family, but the children are losing more cisco's family can easily file for custody of the children between all of this if they can remember what is important now that the children are taken care of and not revenge!

I don't know how you are,but I will say this, I have known Jerry Cisco and, Michelle Wheeler for several years I also knew his very wonderful wife Keri, may her soul rest in peace, and I knew their daughter as well,Both of these women in Cisco's life were wonderful people, however there was a reason for a divorce I believe, and it was abuse! It seems to me you must have been very close to Cisco, or you would try to understand,the whole picture ,from the words you have wrote so far are to accuse, and nobody ever said Wheeler was defenseless,I wrote that her actions were in self defense, you know like in defending her self!And if you truly care what happened in this case, you would try to understand that you don't go from a countless abuser to a kind loving wonderful husband and father! You should ask your self, how well did you really know Cisco! Did you know he was a drug abuser as well,that he shot up cocaine under his toenails,that he beat his first wife, and that he was a truly mental case! Don't get me wrong, Wheeler had her problems as well with drinking, but for the love of God, get your facts straight before you go being the judge and jury! After all didn't you get what you wanted revenge!But that's okay, I put my faith in a higher power than the courts! His name is Jesus!AND I KNOW HE KNOWS THE WHOLE TRUTH IN THE MATTER,Not just a family member, or a friend that lives out of state that thinks they know what happend in this situation!! Think before you type:)

  6. you must havc not known cisco very well or let me rephase that physco cisco yeah thats right he was physco..... why do you think carrie divorced him because he was crazy after all what kind of real man would leave his wife whos dying of cancer for another woman.SOME MAN RIGHT.at least michelle is free from the hell he put her threw now she is much better off. yeah he wassssss a good father until his daughter got old enough to see the monster that he was or was he mistys father we will never know now will we...shit happens for a reason right

  7. its easy for every one sit back and take sides but nobody knows what really happened.it is so sad that the kids lost there father but i think its even sadder that now they have lost there mother to.only because we have a justice system that sucks. i feel like michelle was sentenced for such a longer term that she deserved.if the system would do there job right cisco would have never been out of jail after alllll the domestic violence charges that he had. if the people of the courts would have done there job right cisco would still be alive and wheeler would be able to take care of her kids but instead its the kids that has to suffer due tolack ofthe systems doing there job. i feel if wheeler had a good lawyer things would have worked out better..but in the end its all about the kids loosing there mother and father but at least the kids can visit there mother.

  8. The person asking for a DNA test must be Jerry's so called family? The family that never even seen or talked to their son usless they were bailing him out of jail for DOMESTIC VIOLENCE~ Ironic! And the same family who wouldnt even know the kids if they seen them. They have as much to do with the kids now as they did Jerry when he was alive. I do feel bad for Jerry, and his family for the fact that he is no longer with us. It is very sad and unfortuante. However, anyone who REALLY knew or ever witnessed Michelle and Jerry like I have numerous times would know that all of Michelle's friends and family would of thought she would of been the one killed. After all, it wouldnt of been the first time he has stabbed or cut her. Choked her with a dog chain while being pregnant, or beat her so bad they had to wait to see if she was still pregnant so they knew what to charge him with. I have also been on the phone with Jerry when he threatened Michelle, myself and my husbands life!! I can also recall him going to Michelle's parents house pretending to have a gun behind his back and threatening her entire family on one of the occassions she actually got enough courage to leave him. However, she felt she was putting her family in danger by not being with him so she went back....again. Unless you have been a victim of years of mental, emotional, and physical abuse how dare you place judgement!! And yes, he prob still did love Carrie and who could blame him, however she was smart enough and strong enough to leave him and not continue to live thru the hell Jerry put her through as well. If you ask me that is when Jerry really changed. It wasnt Michelle that changed him, it was Carrie leaving him, divorcing him and unfortunately getting ill and passing on. Michelle sadly fell victim to his anger. No one is this situation is perfect. However, to say Michelle got what she deserves is BS! She lived in fear everyday of her life wether she was living with him or not, taking the life of the man she loved because she knew it was her or him that night, and being away from her children this long is torture enough. She is not happy with what happend nor did she plan it. After all lets not forget, SHE GOT THE KNIFE FROM JERRY!!! She wasnt trying to kill him, she was trying to stop him and save her own life!!!!!!!!!

  9. Loving and caring father?? Yea, when Misty was 5! WHere have you been? Dont you think there is a reason he never seen her anymore? Or maybe she didnt want to see him!!! Loving husband? Apparently not, Carrie left and divorced him right??? I thought so!! People do change and not always for the better!! Im sure Michelle was a ticking time bomb at times, you let someone beat your ass everyday for years and lets see how pleasant you are!!!! Michelle kept going back...your right! She didnt want to live her life constantly looking over one shoulder and fearing he would hurt her family as he had threatened many of times. I guess she felt she would take her chances and keep her family safe. You OBVIOUSLY know the OLD Jerry pre-divorce!! Before his life turned upside down and his drug and alcohol addiction became worse. And as far as his loss of job, income and life goes. You cant work from behind bars for domestic violence nor can you bail yourself out of jail with no money so things were sold for that reason. He can blame no one but himslef for his own actions!!

  11. Wow!where was all this defense for Wheeler when she was being sentenced? No wonder she got 20 years? If someone would have testified to all that, then she might not have gotten the 20 year sentence.

  12. michelle had all this defense during the whole process but had a stupid lawyer thats why we have appeals. they never brought up any of ciscos back ground,his problem with drugs or alcohol abuse ifthey did i'm sure michelle would have gotten a lesser sentenced. his so called family they say jerry was such a good man they did'nt know him at all.jerry left home when he was 11 years old because his mother sexually abused him, he was in foster homes most of his childhood so how can his family even begin to know what kind of man he was.they knew nothing.....his mother and sister are also PHYSCO!!!!!!I GUESS THE APPLE DOESN'T FALL FAR FROM THE TREE!!!!!

Don't worry you people can type all you want about Michelle an say the bad things you want to because, you just can't admit Jerry was a person that had problems to , you can blam it all on Michelle if it makes you feel better! I just hope you guys seek some kind of mental help!Maybe if Jerry had done that after Keri left him none of this would happened,He told me once the reason he would never go home is beacause, his whole family was nuts! Now I believe him! I also know he loved his kids with Michelle very much. I was there the day the 4 year old was born!But I also had talked to Jerry many times! trust me he had mental issues!Most especially about his family and the divorce of his wife!!!! Stop blaming people! I don't really think Jerry would have wanted it to have come to this! I know he would have wanted, Michelle to raise there kids!Or he would have taken them from her long ago!

Why are you double typing wheeler charges, are you trying to make her look worse?.....lol Well its not going to happen!All I can say is keep digging, and trying to find all you can,because what you have is all there is and, I would suggest that you keep her family's name out of you little blogs! I just don't want you to keep ditching Michelle's, After all, its not either of the family's fault,But it is very easy to see you have a very bad temper, just like your brother!So are you giving Michelle's family a threat? I would advise you to watch what you type:) I for one never said any thing about your Mother or his!And as far as him leaving home when he was 18 years old, he must have just lied to those people, you know how it is,once people tell one lie they have to tell many to cover up the first lie, come on you know what I'm saying!

  20. i have also read all of this.but i have something to let the cisco family know. i knew jerry since i was a baby. he was a good guy until carrie disvorced him. then thats when everything changed. i have witness jerry physically abuse michelle plenty of times. jerry is your own family. nd you think you know him? no sorry but you dont.you guys never even came to visit him. you dont know jerry like wedo. nd you dont know what happens behind closed doors. but maybe if you ever came down to see your son nd brother then im pretty sure you would have witnessed him abuse michelle. nd as far as the kids go you guys are being selfish. you guys have never even made an effort to see them. nd even tho you dont beleive them kids arent jerrys even tho they AREEE they are the children jerry loved. them kids are my life nd they deserve there mother. they are in the best of hands just incase you guys cared or wondered. to bad you will neverrrr get to see them. it made sickk when i seen your faces in court because you guys were never here for him. nd the only reason why you came down is so you could seak revenge over michelle you hatedd michelle because you were jealous of her. you didnt care about the justice of your brother nd sons life all you cared about was seeing michelles face when got sentenced you people are S.i.C.K. i could say so much more about what i knoww nd what ive seen but im going to play with the kids bye now.

  21. I'm so surprised at how brave you are behind a screen. We came there to face you, the one's who brought so much pain and injustice to Jerry's life. Not one of you could not look at us in the eye. Now that the truth came out, it seems you are having a hard time dealing with it. We too have had a hard time dealing with knowing that our loved one was murdered. Pray to God, get counseling, and get on with your lives,,,,,we have.....your cruel words will eat you alive and keep the bitterness in your heart. Bitterness turns to hate. Hate leads to murder. Learn something from this tragedy....Let it go! Give it to God, he is the only one who

  22. Thank, you for all your advice to turn my life over to God!He has been my best friend since I was old enough to say, and praise his name, he is an awesome God! I'm so happy you have handed your problems over to him, but so has Michelle......and God is a just God who controls all things, there is a season for all things as well! And I do believe with all my heart and soul, this is Michelle's Season to show the courts the whole truth, as I have said before, God is the only one how knows the whole truth of what happened that morning!You really think that he is going to just let it go at 20 years for a crime of self defense? I think not she will have her day in court again, to prove that she is telling the truth, one day she will get another Lawyer, another time another court and she will be free:)praise God free from abuse verbal and physical, No one to hit her or call her awful names,or tell her any thing, God is doing a powerful work in Michelle, he is making her a whole women again.   24. It is sad that it took Michelle getting caught for her to turn to God but worse than that Jerry was murdered for remaining in that abusive relationship and her out of contril behavior. There is a difference between "being sorry for killing someone" and sorry for getting caught. Had it not been the excellent work of the Ocoee police department she might have gotten away with murder. She not only tried to cover her tracks by saying he comitted suicide but so did her sister Sherry and Kenny, How many apples fell off that tree??? Are these the same people caring for the poor innocent children? God have mercy!!!!!

I recognize that both families are grieving their losses, but I cannot in good conscience, permit further verbal assassinations to continue in this forum.     To both families, I hope that you'll find peace and healing from this tragedy. It will take time. But it is possible.

  26. I had a recorded conversation that has since been long deleted and would like to find out if there are 911 tapes when I had the phone on speaker. I don't understand why none of the 911 tapes were not pulled and why this attorney was allowed to convince Michelle to take the plea and she was promised probation by the state. Why am I getting a sinking feeling about this case???

  27. reading all this is crazy i can't believe people would put and say things they know nothing about i miss him and cry everyday almost 3 years gone by i can't believe this happened i seen him months before she killed him he was afraid and told me to stay away because he was scared of what she would do i wish i could have done something to save him. i pray for the 2 kids that i hear are not being taking care of may jerry rest in peace

  28. im shock this is still going on!!!! why is it people cant see the truth? truth is his gone and she's in prison, and truth is the kids are being very well taking care of. I fell sorry for you not so much for the loss of Jerry , but for the loss of the two beautiful angels left without a father and a mother not to mention thier fathers side of the family. not because he is gone but because of the hate the family has for the mother. would it have been differant if it was the other way around?? would Jerry's family had anything to do with they then. Its funny how they tried to take them in the begining of all this. just so everyone knows there is one person in all this that is more mature then all the adults,, that is those lil angels sister!!! she has loved them, cared for them and made sure no harm has or will ever come to them, she is an beacon of light in this dark mess. may GOD bless her and those babies, and everyone in both family's

From someone who spent many years growing up with Jerry and who would receive phone calls all hours of the night and day to come and help both Jerry and Michelle, this was a relationship on spiral out of control from the first day. And yes I was around on day one, a relationship can't make it when it starts from a rebound on both parts. So to say one is worse than the other is just one trying to justify their opinions both parties are at fault because I personally myself tried to get them to part ways before kids ever came into that relationship, but when two people are in love with the idea and not each other it is a recipe for destruction. I am sure at one point they probably did love each other but when you choose to be of the world and what is in it and think of only our selves we are surely to fall victim to something. In this sad love story gone bad everyone has put the 2 human beings that are now the victims of this in the back ground to argue about something that can never be changed. Jerry has 2 other girls and michelle a daughter that read this as well I am sure and no matter how right or wrong we believe our opinion is about Jerry or Michelle please show respect for those children of both Jerry and Michelle so they may be in piece for what ever time they may have here on this earth, set aside your differents and pray for each other because it says to love your enemy as you love thy self. We all have done our wrong some worse than others but no where does it say GOD will forgive even the worst of the worst.
